Conditions of Sale

Pacific Metal Company does not extend any warranties concerning the material or equipment sold, beyond the description thereof appearing on the face of the Invoice. There are no express warranties. There are no implied warranties of merchantability or fitness for a particular purpose. The liability of the Company is limited to the replacement of, or refund for , defective material or equipment, at its option, if notified of the defect before the material or equipment is used, and this shall be at the sole and exclusive remedy of the buyer, whether in tort, contract or otherwise.

Pacific Metal Company shall not be liable for injury to person or property or for incidental or consequential damages or commercial losses or any other loss or damage.

These commodities are controlled for export by the United States Government under the Export Administration Regulations. Diversion contrary to U.S. Law prohibited. Purchaser is responsible to comply with these regulations if the items are to be exported from the United States or re-exported from a foreign country.

All Sales are subject to Terms and Conditions stated on the Invoice and or Credit Application.
